This letter of demand is a formal request for payment within a certain time frame with a notice that you will apply to Court (or a tribunal) for recovery of that money if it is not paid on time. It is sometimes also called a debt collection letter or a demand for payment.

The letter of demand template should only be used if you have already sent your invoice and requested payment previously and it has not been paid to you. It should be sent before you start any legal proceeding to recover money.

The letter of demand template includes:

• A reference to the invoice or debt that is outstanding (for you to complete and add the specific details);

• Clear details of what will happen if the debt is not paid within a nominated time frame;

• Details of how to pay the debt; and

• A closing paragraph on what will happen if the debt is not paid (e.g. legal proceedings will commence).

You can use this template for a letter of demand in New South Wales, Queensland, Victoria, Western Australia, Northern Territory, the ACT, Tasmania or South Australia.

Instructions for use

You will be required to add the details in the document where prompted in red text, in particular the details of the debt, a copy of the invoice and your payment details.
