The Graphic Design Service Agreement Template is an easy-to-use template that allows you to put your details, the client details, scope, inclusions and exclusions and the price in the Summary of Details Table on the first page of the Agreement. The Agreement Terms and Conditions (or Terms) cover the following:
when the agreement starts and ends;
how you can end the agreement if you aren’t getting on with your client or they breach the contract, such as not paying you;
the obligations of the graphic designer and the obligations of the client;
turnaround times (we have suggested time and mention rush fees but you can decide what these are)
customer obligations around approval time, provision of original content and images or photos;
a limit on retrieval time from your dropbox or gsuite drive (or another share platform) so you aren’t paying extra to keep all that artwork hanging about;
clear payment terms;
a GST clause for when you reach that GST threshold (it can be used whether or not you are registered for GST);
transfer of intellectual property to the client once payment is made (note this agreement transfers ownership of the copyright in the design that the client has paid for - if you want to licence your work but retain copyright and intellectual property rights, get in touch with us here by booking a consult to discuss a licensing agreement);
protection of your liability; and
all the other legal nuts and bolts you expect in an agreement of this type that has been drafted by a lawyer.
How to use this template:
This template is a general template drafted for Australian Laws and requires you to add the details where indicated in red text before using it. All items in red text are limited to the Summary of Details (or table) at the Start of the Agreement and at the signing clauses on page 2 of the Agreement so it is easy to navigate and use. Delete this information page before using the template, but always be sure to keep a master version unedited in case you need it again.
