  • An employment agreement is a legally binding contract between you and your employee that sets out the terms and conditions of employment. This includes hours of work, duties, salary, leave entitlements, confidentiality, and termination rights. In Australia, even if you don’t issue a formal contract, the law still implies there is an employment contract. This means it is critical to have a written agreement to avoid disputes and to clearly outline expectations.

    A well-drafted employment contract also ensures compliance with the Fair Work Act and any relevant Modern Awards.

  • Under Australian employment law, casual, part-time and full-time employees have different entitlements and expectations:

    • Full-time employees work regular hours (usually 38 per week) and receive full leave entitlements.

    • Part-time employees work less than 38 hours per week on regular days and are entitled to leave on a pro-rata basis.

    • Casual employees work irregular hours with no guarantee of ongoing work and receive a casual loading in lieu of leave entitlements.

  • Yes. A job offer letter is not a substitute for a comprehensive employment contract.

    A job offer letter may confirm the position and pay, but it doesn’t protect your business legally the way a properly drafted employment agreement does.

  • Yes. All employment contracts in Australia must comply with the Fair Work Act 2009 (Cth) and the National Employment Standards (NES).

    Your employment agreement can include better conditions than the NES but cannot provide less. If your employee is covered by a Modern Award or Enterprise Agreement, the employment contract must also comply with those terms. Our templates are drafted to align with Fair Work obligations while still allowing flexibility for small businesses.
