The Talent Representative and Photographer Agreement Template is a template agreement between a talent Representative and a photographer to be used when a talent Representative engages a photographer to take photos of the talent they manage.
· This Template is a general template drafted for Australian laws.
· Note that this is an independent contractors agreement and it does NOT create the same employment relationship between the parties as an employment agreement. As a result, a Photographer remains responsible for superannuation, insurance, tax and other leave entitlements and can only collect the agreed Price under the Photographer’s agreement. Before using this template, we suggest you review the Australian Tax Office guidelines for an independent contractor to ensure that your proposed contracting arrangement will not be classed as an employee and employer relationship.
This Agreement contains details service options for commission bookings and bulk photo shoots, regulates the services and editing of photos and has two pricing models that can be chosen - commission pricing model or bulk photo shoot fees. It also details the equipment the photographer is required to have and the process for invoicing.
Instructions for use
· Complete the Schedule and execution pages in full by inserting the details prompted by the red text throughout the document;
· review the document; and
· both parties to review, sign and date on the last page (the Execution Page).
