What is a Registered Design?
A registered design refers to a design registered under the Design Act. When a design is registered, the registration (once granted by IP Australia) protects the visual appearance of a product, not its function. Under the Designs Act, registration gives the owner the exclusive right to use, license or enforce the design for the registration period.
You can only enforce a registered design after it has been certified by IP Australia, which involves an examination to assess its newness and distinctiveness.
What is an Unregistered Design?
In Australia, unregistered designs are not protected under the Designs Act. However, enforcement of your designs may still be possible under:
the Copyright Act 1968 (Cth) (for artistic elements like 2D drawings or CAD files),
the Australian Consumer Law (misleading or deceptive conduct),
passing off at common law (if your branding and reputation are being misused).
