Is your business putting on an event? Or perhaps you have a project? Either way, a sponsor can go a long way towards helping fund your event or project and, when done well, provide brand exposure for you and the sponsor. But is it as simple as taking money and mentioning them once or twice?

The short answer is no, it isn’t that simple!

The long answer is you need a sponsorship agreement that includes things like:

  • definitions of your project or event;

  • details exactly what the sponsor will provide and how you will promote the sponsor during the event;

  • sets out the intellectual property that the sponsor can you use and that your business can use, so no trademarks are infringed and everything is at your fingertips ready to promote the project and the sponsor.

  • details the sponsorship fee and GST arrangements;

  • sets out the obligations of the sponsor;

  • looks at whether the sponsor is exclusive or perhaps you can have many sponsors? It is always a good idea to get this sorted out so everyone is on the same page.

  • covers marketing materials and what the sponsorship promotion will look like;

  • covers confidentiality (after all you might know the sponsorship fee, but this may need to remain confidential);

  • sets out limits on liability; and

  • looks out how the sponsorship agreement can be terminated.

This template:

·       in red text this template requires you to complete missing information specific to you and the Sponsor, including the name of event or project, your business details and details of the Sponsor and sponsorship;

·       has an optional clause designed for you to select whether it is exclusive or non exclusive. Note that by exclusive it means you have one sponsor and only one sponsor whereas non exclusive means you can have more than one sponsor. The optional exclusivity clause is in red text.

·       is a general template drafted for Australian laws and does not incorporate any specific arrangements.
