  • Eligibility to enter

  • The Promoter details for the business running the competition

  • The competition details and whether it is a game of skill or a game of chance (and a handy explanation of the difference between the two)

  • A place to add your permit number if you are running a game of chance and require a permit (see our article here for more information about that)

  • The Competition entry period

  • Details on how to enter the competition

  • When the competition prize draw will be held and how the winner will be decided

  • Details of prizes

  • Details of the winner selection process

  • The law which applies in your state or territory to your competition

  • How personal information is used and releases for social media

  • Limitation of your liability as the competition organiser

It is important that the Competition Terms and Conditions Template is linked for each person to read and accept prior to submitting any entries for the competition. Ideally, a check box confirming agreement to these terms and conditions is preferred. The Competition Terms and Conditions Template should also be referred to and linked to any advertising materials which promote the competition.

Important Information regarding competitions in Australia

Every state and territory in Australia has its own laws in relation to competitions or what are called trade promotions.

For example, in NSW you require a permit if the prize pool is over $10 000 in value or if a scratch and win promotion is on offer - regardless of value. The ACT and Northern Territory have different rules again. Our Blog (available here) provides a great summary of the different rules across the various states and territories of Australia.
